River Oaks construction company sued over Kemah, Cy-Fair projects

A River Oaks builder is being sued over claims it failed to pay a subcontractor for materials and services provided on projects in Kemah and Cy-Fair.

Permabond Construction filed a lawsuit on June 21 in Harris County District Court against Gary Leach and G.T. Leach Builders, of River Oaks, citing breach of contract, negligent misrepresentation, fraud, violations of the Prompt Pay Act and violations of the Texas Trust Fund Statute.

Permabond says that beginning in July 2007, it agreed to be a subcontractor for the defendants on five projects, including the Texas Corinthian Yacht Club project in Kemah and two projects at the Toys “R” Us store located in Cy-Fair’s Willowbrook Mall.

According to the brief, Leach Builders refuses to pay Permabond $50,471.35 for the services and materials provided on these projects.

Permabond Construction is seeking damages, attorney’s fees and court costs. It is being represented in the case by Houston attorney Elizabeth Bruman.
